- Professional claim filing services
- Document management, storage, and blockchain verification
- Weather monitoring and claim alerts
- Photo and video damage analysis
- Voice-enabled claim documentation

ClaimNova makes NO GUARANTEES about claim outcomes, settlement amounts, insurance carrier responses, claim acceptance, or any results from using our services.
NOT A PUBLIC ADJUSTER
ClaimNova is NOT a licensed public adjuster and does not provide public adjusting services. We do not hold public adjuster licenses in any jurisdiction.
NO REPRESENTATION OF PARTIES
ClaimNova does not represent, advocate for, or act on behalf of the insured party or any insurance company. We do not establish attorney-client relationships.

NOT A LICENSED CONTRACTOR
ClaimNova is not a licensed contractor. However, one of our founders is a licensed contractor in the State of Florida.

We adhere to all applicable federal, state, and local regulations. We consult with regulatory entities as needed to ensure compliance with all applicable laws and guidelines.
3User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

- Accept responsibility for all activities under your account
- Not share your account credentials with others
Subscription and Payment
ClaimNova offers various subscription tiers and one-time services:

- Freemium: Free for 7 days with limited usage
- DIY Basic: $39/month with 10x more usage
- DIY Pro: $59/month with 20x more usage
- Professional Filing: $299-$599 per claim (one-time)
Payment Terms
- All fees are non-refundable unless otherwise specified in our refund policy
- Subscription fees are billed in advance on a monthly or annual basis
- We accept major credit cards and cryptocurrency payments
- Failed payments may result in service suspension
Fair Use Policy
Our AI services are subject to fair use limits that vary by subscription tier. Usage limits reset daily at midnight UTC.
Fair Use Policy
All plans are subject to our Fair Use Policy to prevent abuse. We reserve the right to throttle or suspend accounts engaging in automated scraping, botting, or other abusive behavior.
Data Ownership and Intellectual Property
ALL DATA, INFORMATION, CONTENT, AND MATERIALS PROCESSED, GENERATED, OR CREATED THROUGH THE SERVICE ARE THE EXCLUSIVE PROPERTY OF CLAIMNOVA TECHNOLOGY LLC.
This includes, but is not limited to:
- All user-provided data, information, and content
- All processed, analyzed, or enhanced data
- All AI-generated content, analysis, and insights
- All voice recordings, transcriptions, and audio data
- All photographs, videos, and visual content
- All claim-related information and documentation
- All machine learning models trained on user data
Data Removal
We will remove your personal data upon written request to privacy@claimnova.com. Data removal requests will be processed within 30 days of receipt.
MANDATORY ARBITRATION AGREEMENT
YOU ARE AGREEING TO MANDATORY ARBITRATION AND WAIVING YOUR RIGHT TO A JURY TRIAL AND CLASS ACTION LAWSUIT.
Arbitration Requirement
Any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or the relationship between you and ClaimNova shall be resolved exclusively by binding arbitration in accordance with the Delaware Uniform Arbitration Act and the Commercial Arbitration Rules of the American Arbitration Association ("AAA").
Class Action Waiver
You agree that any arbitration shall be conducted on an individual basis only, not as a class action or other representative action. You expressly waive any right to bring or participate in a class action lawsuit, class arbitration, or any other representative proceeding.
Jury Trial Waiver
You expressly waive your right to a jury trial in any legal proceeding arising out of or relating to these Terms or the Service.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. The seat of arbitration shall be Delaware, USA.
Trademarks and Intellectual Property
ClaimNova™ and EstimateIQ™ are trademarks of ClaimNova Technology LLC. All rights reserved.
You may NOT use ClaimNova's name, likeness, logos, trademarks, or any intellectual property without express written permission. You may NOT copy, reproduce, modify, distribute, or create derivative works based on our platform, software, algorithms, or any proprietary technology. Unauthorized use of our trademarks or intellectual property may result in legal action.
Prohibited Uses
You agree not to:
- Use our services for any unlawful purpose or to submit fraudulent claims
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt our services or servers
- Reverse engineer or attempt to extract our proprietary algorithms
- Use automated systems (bots, scrapers) without authorization
- Impersonate others or provide false information
- Violate any applicable laws or regulations
- Copy, reproduce, or create derivative works of ClaimNova™ or EstimateIQ™
- Use our trademarks, logos, or branding without written permission
Limitation of Liability
CLAIMNOVA'S TOTAL LIABILITY to you for any claims arising out of or relating to these Terms or the Service shall not exceed the amount you paid to ClaimNova in the twelve (12) months preceding the claim.
IN NO EVENT SHALL CLAIMNOVA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES.
Indemnification
You agree to indemnify, defend, and hold harmless ClaimNova Technology LLC, Wayland Global LLC, and their respective officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you upload or transmit
- Any claims by third parties related to your use of the Service
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. CLAIMNOVA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
We do not guarantee that our AI assessments will be accepted by insurance carriers. Our services are tools to assist with claim preparation and do not constitute legal or professional insurance advice.
Termination
We reserve the right to terminate or suspend your account at any time for violations of these Terms of Service or for any other reason at our sole discretion. Upon termination:
- Your right to use our services will immediately cease
- You remain liable for all charges incurred before termination
- Provisions that should survive termination will remain in effect
- We may retain your data as required by law or for legitimate business purposes
Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of any material changes via email or through our platform. Continued use of our services after changes constitutes acceptance of the new terms.
